Terms of Service

These Terms of Service ("Terms") govern your use of AI IQ, a Visual Studio Code extension developed and operated by AIFirstPartner (Edwin Ashdown, Brisbane, Australia). By installing or using AI IQ, you agree to these Terms.
1. The service
AI IQ is a VSCode extension that monitors Claude Code sessions in real time, providing session health metrics, coaching alerts, and AI-powered analysis. AI IQ is offered in two tiers:
- Free tier: Core monitoring features including live session health, rolling metrics, sentiment tracking, 3 alert types, session picker, 1 AI deep analysis per session, and JSON export.
- Pro tier: Everything in Free, plus all 7+ alert types, unlimited AI deep analysis, CLAUDE.md rule injection, session history and trends, multi-session dashboard, spider chart scoring, custom alert thresholds, desktop notifications, coaching prompt export, and multi-workspace support.
2. Accounts and licence keys
The Free tier requires no account or licence key. To use Pro features, you must purchase a licence key through our payment provider, Lemon Squeezy. Your licence key is personal to you and tied to the email address used at purchase. You may use your licence key on multiple machines for your own personal or professional use. You may not share, redistribute, or resell licence keys.
3. Payment and billing
Pro subscriptions are billed monthly ($9 USD/month) or annually ($79 USD/year). All payments are processed by Lemon Squeezy (merchant of record) through Stripe. Prices are in USD and may be subject to local taxes as determined by Lemon Squeezy.
Subscriptions renew automatically unless cancelled before the renewal date. You can cancel your subscription at any time through your Lemon Squeezy customer portal. Cancellation takes effect at the end of the current billing period.
4. Refund policy
We offer a 14-day money-back guarantee on all Pro purchases. If you are not satisfied with AI IQ Pro for any reason, contact us within 14 days of your purchase date for a full refund, no questions asked. Refund requests should be sent to Support@aifirstpartner.com.
After the 14-day period, refunds are provided at our discretion.
5. Bring Your Own Key (BYOK)
The AI deep analysis feature requires you to provide your own API key for an AI provider (Anthropic, OpenAI, or Azure OpenAI). You are responsible for:
- Maintaining a valid API key and sufficient credits with your chosen provider
- Any costs incurred with your AI provider when using the deep analysis feature
- Complying with your AI provider's terms of service and usage policies
AIFirstPartner is not responsible for charges from your AI provider, API outages, or changes to third-party pricing.
6. Your data
AI IQ processes session data locally on your machine. We do not collect, transmit, or store your session data, source code, or project information on our servers. See our Privacy Policy for full details.
7. Acceptable use
You agree not to:
- Reverse engineer, decompile, or disassemble the Pro licence validation mechanism
- Share, redistribute, or resell licence keys
- Use AI IQ in any way that violates applicable laws
- Attempt to circumvent the Free/Pro feature gating
8. Intellectual property
AI IQ, its coaching algorithms, alert logic, and analysis prompts are the intellectual property of AIFirstPartner. The Free tier's core monitoring features are provided under the MIT licence. Pro features, coaching algorithms, and analysis logic are proprietary.
Your code, session data, and AI analysis results remain your property.
9. Disclaimers
AI IQ is provided "as is" and "as available" without warranties of any kind, express or implied. Specifically:
- Session health scores and coaching alerts are estimates and suggestions, not guarantees of code quality
- AI deep analysis results depend on your chosen AI provider and may vary
- We do not guarantee that AI IQ will detect all anti-patterns or improve your session outcomes
- Cost tracking is an estimate based on published model pricing and may not exactly match your provider's invoice
10. Limitation of liability
To the maximum extent permitted by law, AIFirstPartner shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, or goodwill arising from your use of AI IQ.
Our total liability for any claims arising from these Terms or your use of AI IQ shall not exceed the amount you have paid us in the 12 months prior to the claim.
11. Changes to these Terms
We may update these Terms from time to time. Changes will be noted by updating the "Last updated" date. Continued use of AI IQ after changes constitutes acceptance of the updated Terms. For material changes, we will notify you via the extension or email.
12. Governing law
These Terms are governed by the laws of Queensland, Australia. Any disputes shall be resolved in the courts of Queensland, Australia.
